1. Acceptance of Terms
Welcome to www.nw-cw.com (the "Site"), operated by NWCW, LLC ("Company," "we," "us," or "our"). By
accessing or using this Site, you ("User," "you," or "your") agree to be bound by these Terms of Service
("Terms"). If you do not agree to these Terms, you must not access or use the Site.
These Terms constitute a legally binding agreement between you and NWCW, LLC. We reserve the right to
modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last
Updated" date. Your continued use of the Site following any changes constitutes acceptance of those

2. Description of Services
NWCW, LLC is a licensed concrete waterproofing company serving the Puget Sound region of Washington
State, including Pierce County and Kitsap County. We provide commercial and residential waterproofing
services.
The Site provides information about our services, allows users to request free estimates, contact us with
inquiries, and subscribe to newsletters. The Site does not constitute a binding offer to perform services.
3. Free Estimates and Service Agreements
Free estimates provided through the Site or following a site inspection are non-binding and are provided for
informational purposes only. An estimate does not constitute a contract or guarantee of pricing.
All waterproofing and construction services will be governed by a separate written service agreement or
contract executed by both parties prior to the commencement of work. That agreement will contain the
specific scope of work, pricing, timeline, warranty terms, and other applicable conditions.
In the event of any conflict between these Terms and a signed service agreement, the signed service
agreement shall control.

4. User Responsibilities
By using the Site, you agree to:
• Provide accurate, current, and complete information in all forms and communications
• Use the Site only for lawful purposes and in accordance with these Terms
• Not attempt to gain unauthorized access to any portion of the Site or its systems
• Not use the Site to transmit any viruses, malware, or other harmful code
• Not use automated systems (bots, scrapers, etc.) to access the Site without our written permission
• Not impersonate any person or entity or misrepresent your affiliation with any person or entity

The NWCW name, NW Concrete Waterproofing name, logo, and all related marks are trademarks of
NWCW, LLC. You may not use, reproduce, or distribute any content from this Site without our prior written
consent.
You are granted a limited, non-exclusive, non-transferable license to access and view the Site for personal,
non-commercial purposes related to evaluating or engaging our services.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND INFORMATION PROVIDED ON THE SITE ARE
PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS
OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED
TO:
• Your use of or inability to use the Site
• Any content, information, or materials obtained from or through the Site
• Unauthorized access to or alteration of your transmissions or data
• Any errors, inaccuracies, or omissions in Site content
• Any reliance you place on information provided on the Site
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR
RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES
ONLY TO CLAIMS ARISING FROM USE OF THE SITE AND DOES NOT LIMIT LIABILITY ARISING FROM
A SIGNED SERVICE AGREEMENT.
Some states do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or
all of the above limitations may not apply, and you may have additional rights.
8. Indemnification
You agree to indemnify, defend, and hold harmless NWCW, LLC and its officers, directors, employees,
agents, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, and
expenses (including reasonable attorneys' fees) arising out of or related to:
• Your use of the Site
• Your violation of these Terms
• Your violation of any applicable law, regulation, or rights of a third party
• Any content or information you submit through the Site
9. Third-Party Links and Content
The Site may contain links to third-party websites, resources, or services that are not owned or controlled by
NWCW, LLC. We do not endorse and are not responsible for the content, products, services, or privacy
practices of any third-party websites. You access third-party sites at your own risk.
10. Washington State Contractor Licensing
NWCW, LLC is a licensed and bonded contractor in the State of Washington. All work is performed in
accordance with applicable Washington State contractor licensing requirements, building codes, and
regulations. Our contractor license information is available upon request.
Nothing on this Site should be construed as an offer to perform work in any jurisdiction where we are not
properly licensed.

11. Dispute Resolution and Governing Law
a. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington,
without regard to its conflict of law provisions.
b. Informal Resolution
Before filing any formal legal action, you agree to first contact us at sales@nw-cw.com and attempt to
resolve the dispute informally for at least thirty (30) days.
c. Jurisdiction and Venue
If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms
or the Site shall be brought exclusively in the state or federal courts located in Pierce County, Washington.
You consent to the personal jurisdiction and venue of such courts.
d. Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS OR DISPUTES ARISING OUT
OF OR RELATED TO THESE TERMS OR THE SITE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS
ONLY, AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
12. Termination
We reserve the right to terminate or suspend your access to the Site, without prior notice or liability, for any
reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Site will
immediately cease.
All provisions of these Terms that by their nature should survive termination shall survive, including
intellectual property provisions, warranty disclaimers, limitation of liability, and dispute resolution.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent
jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable
provision shall be modified to the minimum extent necessary to make it valid and enforceable while
preserving the original intent.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NWCW,
LLC regarding your use of the Site. These Terms supersede all prior or contemporaneous agreements,
communications, and proposals, whether oral or written, between you and NWCW, LLC regarding the Site.
These Terms do not supersede or replace any signed service agreement, contract, or warranty document
between you and NWCW, LLC regarding specific waterproofing or construction services.
